Terms of Service

1. Acceptance of Terms

By accessing or using Meaple ("the App" or "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the App.

These Terms constitute a legally binding agreement between you and MX Development ("we", "us", "our"), the owner and operator of Meaple.

2. Description of Service

Meaple is a mobile application that helps users track their eating habits and receive personalised AI coaching. The App offers:

  • AI-powered meal analysis via camera (using Google Gemini)
  • Daily point budget tracking
  • Personalised coaching based on your health goal and effort level
  • Weight tracking with history
  • Meal history with calendar view

3. Age Requirements

You must be at least 13 years old to use Meaple. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian.

By using the App, you confirm that you meet these age requirements.

4. Account and Registration

To use certain features of the App, you must create an account. By creating an account, you agree to:

  • Provide accurate and up-to-date information
  • Keep your account credentials confidential and secure
  • Be responsible for all activity that occurs under your account
  • Contact us immediately if you suspect your account has been compromised

5. Acceptable Use

You agree to use the App only for lawful purposes and in a manner that does not:

  • Violate the rights of others
  • Breach any applicable laws or regulations
  • Damage, disrupt, or compromise the App or its servers
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use automated scripts or bots to interact with the App

6. In-App Purchases and Subscriptions

Meaple offers premium features via subscription. By purchasing a subscription, you agree that:

  • You will pay the price shown at the time of purchase
  • All subscriptions are processed through the Apple App Store
  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You are responsible for managing and cancelling your subscription through your Apple ID account settings
  • You must cancel at least 24 hours before the end of the current billing period to avoid renewal

Refunds: All purchases are processed by the Apple App Store. Refunds are handled according to Apple's refund policy. If you cancel a subscription, you retain access to premium features until the end of the current billing period.

7. Intellectual Property

All rights, title, and interest in and to the App, including all intellectual property rights, remain the property of MX Development and its licensors.

You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease the App without our express written permission.

8. User Content

You retain all rights to the content you enter in the App, such as meal data, photos, and other information ("User Content"). By submitting User Content, you grant us a licence to use, store, and process that content solely for the purpose of providing and improving the Service.

Please note that meal photos may be transmitted to Google Gemini for AI analysis — see our Privacy Policy for details.

9. Medical Disclaimer

IMPORTANT: Meaple is a nutritional tracking tool and is not intended as medical advice, diagnosis, or treatment.

  • The App is not a substitute for professional medical advice
  • Always consult a qualified healthcare provider before making significant dietary changes
  • Nutritional information in the App may not be complete or accurate for your specific situation
  • We are not responsible for decisions you make based on information from the App
  • AI-generated point and calorie estimates are approximations and may not be fully accurate

10. Service Availability

We aim to keep the App available at all times but do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue the App at any time without prior notice.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for direct, indirect, incidental, or consequential damages, including loss of data, profits, or other losses resulting from your use of or inability to use the App.

Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim, or €50, whichever is greater.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for violations of these Terms or fraudulent conduct.

You may delete your account at any time from within the App. See our Account Deletion page for instructions.

13. Changes to These Terms

We reserve the right to update these Terms of Service at any time. We will notify you of significant changes via an in-app notification or email. Your continued use of the App after changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes will be submitted to the competent courts of the Netherlands.
